This website and our services are owned and operated by Heartful Roots, PLLC ("we," "our," or "us"). By accessing or using our website, www.salkasanctuary.com (the "Site"), and booking our spiritual services, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use this Site or book our services.
1. Corporate Structure & Brand Disclosure
Please be advised that Salka Sanctuary is a registered trade name (DBA) entirely owned and operated by Heartful Roots, PLLC. All financial transactions, liabilities, and agreements made under this brand are legally tied to the parent entity, Heartful Roots, PLLC.
2. Dual-Practice Clinical Disclaimer (Not Therapy)
The founder and practitioner, Jessica Gershwin, is a Licensed Independent Clinical Social Worker (LICSW) in the State of Vermont. Heartful Roots, PLLC operates a distinct, separate clinical mental health practice under a different brand name. However, you explicitly acknowledge and agree to the following:
Non-Clinical Modality: Shamanic healing, energy work, and spiritual consulting are strictly non-clinical, unregulated, and spiritual modalities.
Not Psychotherapy: The services provided under this brand do not constitute mental health counseling, psychotherapy, psychiatric care, or medical treatment.
No Medical Claims: The practitioner will not diagnose, treat, or cure any physical or mental medical conditions during these sessions.
Jurisdiction: Because these sessions are strictly spiritual in nature, they are not governed or regulated by the Vermont Office of Professional Regulation (OPR).
No Cross-Referencing: To maintain strict ethical boundaries required by licensing standards, clients of Salka Sanctuary are permanently ineligible to become clinical mental health clients of Jessica Gershwin’s separate psychotherapy practice, and vice versa.
3. Financial Terms & Payment Policies
Payment: Payments for all private sessions, workshops, or digital items are due in full at the time of booking or checkout unless a formal payment plan has been explicitly agreed upon in writing.
Payment Processing: All payments are securely processed through our third-party provider, Stripe/Square. Your financial statements will display charges under the name Salka Sanctuary.
4. Intellectual Property Rights & AI Scraping Prohibition
Ownership: All content on this Site—including but not limited to text, original spiritual articles, graphics, logos, audio recordings, and guided meditations—is the sole intellectual property of Heartful Roots, PLLC and is protected by copyright laws.
Permitted Use: You are granted a limited license to view the Site for personal, non-commercial use. You may not copy, reproduce, distribute, or sell any content from this Site without explicit written permission.
AI Scraping Restriction: You are strictly prohibited from using bots, web crawlers, scrapers, or any automated data extraction tools to crawl, index, download, or harvest content from this Site for the purpose of training artificial intelligence (AI) models or large language models (LLMs) without a formal commercial licensing agreement.
5. Assumption of Risk & Limitation of Liability
Voluntary Participation: You acknowledge that your participation in shamanic healing and energy work is completely voluntary. You knowingly assume all risks, emotional, spiritual, and physical, associated with deep introspective or energetic work.
Limitation of Liability: To the maximum extent permitted by law, Heartful Roots, PLLC, its officers, and its practitioners shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of this Site, your reliance on its content, or your participation in our spiritual services.
6. Governing Law & Jurisdiction
These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Vemont, without regard to its conflict of law principles. Any legal actions or proceedings must be filed exclusively in the state or federal courts located in Montpelier, Vermont.
